The Lahore High Court (LHC) has delivered an important judgment reinforcing women’s legal and religious rights regarding Haq Mehr, ruling that it is a mandatory obligation of the husband and not a voluntary favor. The court emphasized that Haq Mehr is a legally enforceable debt owed by the husband to his wife and must be fulfilled according to the commitments made at the time of marriage.
The ruling came in a case where a woman approached a family court seeking enforcement of a written agreement under which her husband had promised her a five-marla house along with maintenance during the iddat period. The agreement was reportedly signed on the day of the marriage. The husband later challenged the claim, arguing that the document was fabricated and prepared after the marriage.
After reviewing evidence and hearing witness testimonies, the Lahore High Court upheld the family court’s decision in favor of the woman. The court found that witnesses had confirmed the authenticity of the agreement, making it legally valid and enforceable.

In its detailed observations, the court stressed that any amount, property, or benefit agreed upon as Haq Mehr—whether recorded in the Nikah Nama or in a separate written agreement—is legally binding on the husband. The judgment further noted that women often do not demand Haq Mehr during marriage due to social, cultural, or family pressures. However, the court clarified that failure to claim Haq Mehr does not mean a woman has surrendered or waived her right.
The court also highlighted that under Islamic principles, Haq Mehr can be agreed upon verbally, in writing, or even after marriage, and its value may be increased later with mutual consent.
The ruling is being viewed as a significant step toward protecting women’s rights and ensuring justice in family matters. The court directed family courts to consider social realities alongside legal provisions when deciding such cases, helping ensure fair and balanced outcomes for all parties involved.
