The Islamabad High Court (IHC) has ruled that banks cannot block or freeze citizens’ bank accounts without a verified legal basis, strengthening protections for account holders against arbitrary restrictions.
The decision came during the hearing of a case in which a citizen challenged a private bank’s unilateral action of blocking his account during an inquiry conducted by the National Cyber Crime Investigation Agency (NCCIA). Justice Arbab Muhammad Tahir issued a detailed six-page written judgment in the matter.
According to the court’s findings, the bank acknowledged that it had wrongly blocked the customer’s account without sufficient justification. The judgment emphasized that financial institutions must have a valid and lawful reason before restricting access to any individual’s bank account.
In addition to ordering the restoration of the customer’s rights, the court directed the bank to pay Rs. 300,000 to cover the legal expenses incurred by the account holder while pursuing the case.
The IHC also urged the State Bank of Pakistan to take proactive measures to prevent similar incidents in the future. The court recommended that the central bank review the case and issue clear guidelines to all commercial banks regarding account restrictions and customer rights.
The judgment further stated that precautionary regulations should explicitly clarify that no individual can be denied access to their bank account without lawful authority and proper legal grounds. The court stressed that citizens should not suffer inconvenience or financial hardship due to unjustified actions by banks.
Legal experts say the ruling is an important precedent for consumer protection in Pakistan’s banking sector and reinforces the principle that financial institutions must operate within the boundaries of law and due process when dealing with customers’ accounts.
